In most cases, we are able to reach a fair settlement outside of the court system. However, reasonable settlements cannot always be reached and we must take the case to court. We try cases before qualified trial judges and juries of your peers, depending on the type of personal injury case.

Workers’ Compensation cases are initially tried to an Administrative Law Judge. These cases can be appealed to the Workers’ Compensation Commission, which is a panel of three Commissioners appointed by the Governor. Appeals from the Workers’ Compensation Commission are made to the Arkansas Court of Appeals. Appeals from the Arkansas Court of Appeals can be made to the Arkansas Supreme Court.

Car wrecks, truck wrecks, premises liability, and product liability claims are typically filed in a state Circuit court, and your case is tried to a jury of your peers. Appeals are made directly to the Arkansas Court of Appeals and subsequent appeals can be made to the Arkansas Supreme Court. Some of these types of personal injury cases are allowed to be filed in Federal Court, and appeals from Arkansas Federal Courts are made to the Eighth Circuit Court of Appeals in St. Louis, Missouri. I have practiced law, tried cases, and argued appeals in all of these various courts and jurisdictions.
